Release of Liability Waiver

Anyone wishing to participate at CirqueHaus in any way must complete this waiver to enter the building.

Release of Liability:

In relation to private lessons, personal training, workshops, events, and general participation in aerial, acrobatic, and circus skills training and related activities will be referred to as “the Activities” from here forward.

By participating in any activity at CirqueHaus, you are agreeing that :

1. I understand that training Circus carries some dangers, and will do my best to comport myself safely.

2. I understand that the Activities are physically demanding and I am in an appropriate physical condition to participate.

3. I have taken medical advice on any pre-existing conditions or concerns and confirm that it is medically and physically safe for me to participate in the Activities.

4. I will inform the Activities organizers of any physical or medical conditions that may result in me requiring special attention.

5. If my physical condition changes (due to injury, illness, pregnancy, or otherwise) I will seek medical advice before continuing to participate in the Activities.

6. I acknowledge that there are risks involved in the Activities, and fully assume the risks associated with my participation. I understand and acknowledge that the Activities organizers (including all teachers and volunteers) provide no warranties, and I indemnify the Activities organizers and instructors against any costs or losses resulting from my participation.

7. I agree that to the extent permissible by law, the Activities organizers (including all teachers and volunteers), any sponsors and other parties associated with the Activities, have no liability to me for any direct or indirect loss (including but not limited to injury or death) sustained by me during or in any way related to my participation in the Activities.

8. I will participate in the Activities in a manner that does not endanger either me or others.

9. I have read and agree to comply with the rules and regulations set out in the Safety Policies & Rules pertaining to the Activities. I know how to locate these on CirqueHaus’s website and will check them regularly, both for updates and to refresh my memory of them. I understand that it is my responsibility to make sure I know and understand all of the rules, regulations, terms and conditions of participation.

10. I understand that I may receive physical adjustments to enhance or correct my body posture or position during class by either the teacher or an assistant. I take accountability for alerting the teacher or assistant of any injury or impairment that may be affected by these adjustments, or if I do not want to receive any assists.

11. I understand and agree that situations may arise during the Activities which may be beyond the immediate control of the organizers (including all teachers and volunteers).

12. I understand that if I bring my own equipment to train on or with then it is my sole responsibility to ensure that that equipment is safe for use and I must have my own public liability insurance policy in place in order to do so. If I allow anyone else to train on or with my own equipment I will make it clear that it is my own equipment and does not belong to the Activities organizers, and I assume sole responsibility for its use.

13. I understand that if I train on equipment that is not owned by the Activities organizers then I do so entirely at my own risk.

14. I understand that if, in the Activities organizers’ opinion, my behavior is unsafe, disruptive or otherwise inappropriate then I may be asked to cease participating and/or leave the premises. I understand that I have no right to continue participation in the Activities if this happens, and I will not be refunded or compensated.

15. I consent to receiving medical treatment in the event of illness or injuries suffered during or after the Activities.

Photo Release:

1. I understand that CirqueHaus may photograph or video record periodically to capture what happens in our facilities for safety and/or training and/or promotional purposes and I consent to such video recording.

2. Your/your students' image may be captured and used in CirqueHaus’ media. This assists our organization to spread the word about our facilities, which in turn helps support our programs. Students' names will never be shared without specific consent.

3. I authorize the use of my image in any broadcast, telecast, promotion, advertising, and in any other way, without compensation. It is my duty to inform the Activities organizers if I choose to withdraw this consent.

COVID-19 Agreement, Release and Assumption of Risk:

In consideration of the services of CirqueHaus, their agents, owners, officers, volunteers, participants, employees, and all other persons or entities acting in any capacity on their behalf (herein after collectively referred to as “CirqueHaus” and/or “releasees”), I hereby agree to release, indemnify, and discharge CirqueHaus, on behalf of myself, my spouse, my children, my parents, my heirs, personal representative and estate as follows:

1. I represent that I am in good health and have had no known exposure to COVID-19 and no symptoms of COVID-19 prior to entering CirqueHaus’ facility. I acknowledge that if I believe I have had any exposure to COVID-19, I will immediately cease attendance at CirqueHaus’ facility until I can again warrant that I have had no known exposure or a negative test and alert the facility if I have been on the premises since my exposure.

2. I understand that CirqueHaus is making its best efforts to reduce the risk of transmission of COVID-19. But the safety of the community is in the hands of every one of us. I expressly agree and promise to abide by the safety guidelines posted on CirqueHaus’ website for activities in its facility.

3. I am aware that training during and after the COVID-19 pandemic involves certain inherent risks, dangers and hazards, which can result in serious infection, personal injury or death. I further acknowledge, understand, appreciate, and agree that my participation may result in possible exposure to and illness from COVID-19. While protocols and personal discipline may reduce this risk, the risk of serious injury, illness, and even death is not possible to fully mitigate.

4. I hereby freely agree, to assume and accept all known and unknown risks of exposure to COVID-19, even arising from the negligence of the releasees or others and assume full responsibility for my participation.

5. I hereby waive, release, and discharge all claims that I have or may have in the future, and covenant not to sue your business, its administrators, directors, agents, officers, volunteers, employees, contractors, other participants, any sponsors, advertisers, owners, and lessors of the premises on which the activity takes place (each considered one of the "releasees"; herein) from all liability, claims, demands, losses, damages, on my account caused or alleged to be caused in whole or in part by the negligence of the releasees or otherwise, including negligent rescue operations.

6. I further agree that if, despite this release, waiver of liability, and assumption of risk, I or anyone on my behalf makes a claim against any of the releasees, I will indemnify, defend, and hold harmless each of the releasees from any loss, liability, damage, or cost, including attorneys' fees, which any of the aforementioned may incur as a result of such a claim.

7. I have read this Agreement and I fully understand its terms. I understand that I am giving up substantial rights, including my right to sue the facility and its staff for injuries resulting from the inherent risks of training during and after the COVID-19pandemic, and the ordinary negligence of the facility and staff. I further acknowledge that I am signing this agreement freely and voluntarily, without inducement or assurance of any nature, and intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by the laws of the state of New York.
